Terms and Conditions of Use

Welcome to WonaSports.

These Terms and Conditions of Use (hereinafter, the “Terms”) govern access to and use of the mobile application, digital platform, website and technology services offered by WonaSports.

By downloading the application, registering, accessing or using any of the available features, the user declares that they have read, understood and accepted these Terms and WonaSports' supplementary policies.

If the user does not agree with these Terms, they must refrain from using the platform.

WonaSports is a digital technology platform intended to connect users with independent sports centers.

The platform allows users to:

• Find sports centers.
• Check availability.
• Make bookings.
• Purchase memberships.
• Manage sports activities.
• Receive communications related to contracted services.

In addition, WonaSports provides technology management tools for sports centers, including:

• Sports complexes.
• Courts and fields.
• Gyms.
• Fitness centers.
• Training studios.
• Sports academies.
• Other establishments related to sports activities.

The user acknowledges and accepts that:

• WonaSports does not directly provide sports services.
• WonaSports is not:
  • The owner of the sports facilities.
  • The operator of gyms.
  • The organizer of sports activities.
  • A coach.
  • An instructor.
  • Responsible for classes.
  • Responsible for sports facility rentals.

WonaSports solely provides a technology tool that connects users interested in taking part in sports activities ↔ sports centers that offer such services.

When a user makes a booking, purchases a membership or contracts any service within WonaSports, a direct relationship is created between User ↔ Sports Center.

The Sports Center is solely responsible for providing the contracted service, which includes:

• Actual availability.
• Condition of the facilities.
• Quality of the service.
• Staff, instructors and coaches.
• Compliance with schedules.
• Safety and access conditions.
• Permits, insurance and medical requirements.
• Internal policies.

WonaSports is not a party to that commercial relationship and does not assume obligations inherent to the sports service.

Downloading and registering with WonaSports is free of charge. The user may:

• Create an account.
• Explore sports centers.
• Search for activities.
• Consult information.
• Use the available features at no cost.

Payments made within the platform correspond exclusively to services offered by sports centers, such as:

• Court bookings and deposits.
• Full payments for activities and classes.
• Memberships and subscriptions.

To use certain features, the user must create an account by providing valid and up-to-date information. The user agrees to:

• Provide truthful information.
• Keep their data up to date.
• Protect their credentials.
• Not share their account with third parties.

WonaSports may request identity validation mechanisms, including phone validation via SMS and a photograph of the user.

Each account corresponds to one specific person. The following is strictly prohibited:

• Creating fake accounts.
• Using third-party data.
• Creating multiple accounts to evade restrictions.
• Using incorrect information or impersonating another person.

WonaSports may take legal and technical action when it detects fraud, abusive use, manipulation of the system or attempts to avoid sanctions.

Bookings made through WonaSports are managed technologically by the platform, but correspond to services offered by each Sports Center.

Each establishment sets its own:

• Available time slots and capacity.
• Prices and commercial conditions.
• Activity duration and access requirements.

The published information is managed by each Sports Center through the tools provided by WonaSports.

Each Sports Center may establish its own:

• Booking and cancellation policies.
• Modification conditions and attendance rules.
• Refund conditions and special requirements.

Before confirming a booking, the user must view and accept the particular conditions applicable to the selected establishment. Confirming the booking means that the user has read, understood and accepted those policies.

The user acknowledges that each establishment may operate under different conditions. Therefore, differences may exist between centers regarding prices, schedules, cancellation policies, refunds, memberships and access requirements.

WonaSports does not set or modify the individual commercial conditions of each establishment.

WonaSports enables payments related to sports services through the payment methods available within the application (bookings, deposits, full payment, memberships, subscriptions).

The user acknowledges that payments correspond to services provided by the selected Sports Center. WonaSports acts solely as a technology facilitator of the process.

Payments made within WonaSports are processed through specialized external providers (such as Mercado Pago or other enabled methods).

WonaSports:

• Does not store full card details.
• Does not have access to security codes.
• Does not directly handle sensitive financial information.

The handling of payment data corresponds exclusively to the provider used, in accordance with its own terms and security policies.

Each Sports Center sets the price of its services, booking fees, memberships, promotions and applicable taxes. WonaSports does not determine or modify published prices. The user must verify all information before confirming a transaction.

WonaSports allows certain Sports Centers to offer memberships or recurring plans.

• The commercial relationship is established directly between the user and the Sports Center.
• The Sports Center defines the price, benefits, duration, included activities and applicable rules.

Some Sports Centers may use automatic debit or periodic renewal features through enabled payment providers.

The user accepts that:

• The subscription may renew automatically according to the conditions disclosed at the time of purchase.
• Debits will be processed through the corresponding payment provider.
• They must verify the charge date, amount, plan conditions and cancellation policy.

Cancellation of a membership must be requested by the user directly from the corresponding Sports Center, unless WonaSports expressly enables another mechanism within the platform. The Sports Center is responsible for processing the cancellation, applying its internal policies and disclosing cancellation conditions.

Each Sports Center establishes its own policies for cancellation, rescheduling, refunds, penalties, deposits and minimum notice periods. These conditions will be shown to the user before confirming the booking.

By confirming a booking or service, the user declares that they have read, understood and accepted the rules and policies of the Sports Center. WonaSports will not be liable for the user's lack of awareness of policies previously disclosed and accepted.

Sports Centers may cancel or modify bookings in accordance with their own conditions and operational circumstances (e.g. availability issues, maintenance, weather, force majeure). Communication and resolution will be handled according to the establishment's own policies.

WonaSports does not directly control or supervise the provision of the sports service. Each Sports Center is solely responsible for the quality of the service, condition of the facilities, safety, contracted staff, coaches, equipment and customer care provided. WonaSports does not guarantee sports results or any particular experience.

Sports Centers may request medical certificates, fitness clearances or health declarations. The user is solely responsible for meeting those requirements and for consulting medical professionals. WonaSports does not carry out medical assessments or determine users' physical fitness.

Sports Centers are responsible for the photographs, videos, promotions and descriptions they publish within the platform. WonaSports does not guarantee that images are recent, that promotions remain valid or that facilities match the published content exactly.

WonaSports allows users to rate Sports Centers through scoring systems (e.g. stars).

• Ratings are anonymous and do not allow public comments.
• It is prohibited to manipulate scores, create fake accounts to alter reputations or run artificial rating campaigns.
• WonaSports may investigate and remove fraudulent ratings.

The user undertakes to use WonaSports responsibly. The following is strictly prohibited:

• Using the platform for illegal or fraudulent purposes.
• Impersonating others or providing false data.
• Intentionally harming sports centers or third parties.
• Attempting to breach or interfere with the platform's technology systems.

WonaSports may suspend, limit or cancel accounts on a preventive or definitive basis in the event of:

• Breach of these Terms.
• Fraud, abusive use or manipulation of bookings.
• Creation of multiple accounts to evade sanctions.
• Attempts at unauthorized access or harmful conduct.

All intellectual and industrial property rights over WonaSports belong exclusively to the platform or its licensors. This includes trademarks, logos, source code, object code, interface design, databases, algorithms, methodologies and developed features. Use of the platform does not grant any license or assignment of intellectual property rights.

WonaSports is a registered trademark protected by law. Its use, reproduction or modification without prior written authorization is prohibited.

It is prohibited to:

• Use names or distinctive signs that may cause confusion.
• Register domains or create applications with similar visual identities.
• Exploit WonaSports' reputation for one's own benefit.

It is prohibited to copy, reproduce, modify, decompile, extract components from or create derivative versions of the WonaSports platform. It is specifically prohibited to use knowledge obtained from the platform to develop products or services that compete in sports bookings, facility management or sports marketplaces.

Except with express written authorization, it is prohibited to analyze the source code, reverse engineer, decompile or attempt to breach the security mechanisms of WonaSports' systems.

It is prohibited to access the platform through private APIs, unauthorized endpoints, bots, automated agents or mass extraction tools. Any external technical integration requires prior written authorization and compliance with WonaSports' commercial conditions.

It is prohibited to use bots, chatbots, virtual assistants or AI systems to access WonaSports directly or indirectly.

Prohibited examples:

• Third-party chatbots (e.g. WhatsApp) that query WonaSports availability.
• Automated assistants that make bookings or mass queries.
• External applications that use data extracted from the marketplace.

The information published on WonaSports constitutes a commercial technology asset. Scraping, mass data downloads, copying prices or center availability, and compiling databases of users or establishments to create competing services or commercial databases are prohibited.

Any conduct that causes excessive server consumption, infrastructure overload or service degradation will be considered a serious violation. WonaSports may block access, suspend accounts and seek compensation for the damages caused.

Sports Centers are responsible for the acts of their agencies, developers or external technology providers. Contracting third parties does not authorize those parties to access WonaSports' systems.

Unauthorized use of the systems, data extraction or technological attacks entitle WonaSports to seek legal redress for economic damages, infrastructure costs, commercial losses, reputational harm and legal expenses.

Marketplace information is provided exclusively so that end users can search for and contract services within WonaSports. Its use to create external directories, parallel marketplaces or to redirect users off the platform is prohibited.

WonaSports reserves the right to immediately suspend, without prior notice, any accounts or access showing signs of fraud, security breaches, data extraction or intellectual property violations.

WonaSports strives to maintain the stability of the platform but does not guarantee uninterrupted service. No liability is assumed for system outages resulting from maintenance, technical failures, Internet provider failures or events beyond the platform's control.

WonaSports will not be liable for delays or non-performance caused by reasons beyond its reasonable control, such as general Internet outages, natural disasters, third-party failures, government regulations or extraordinary situations.

The user agrees to receive in-app notifications, push notifications, emails or SMS messages related to their bookings, payments, account security and service updates. Such communications will not be considered spam or purely commercial content.

WonaSports provides the infrastructure for establishments to contact the user regarding bookings or modifications. WonaSports does not control and is not responsible for the content of communications sent directly by Sports Centers.

WonaSports may add, modify or discontinue features, designs and technology tools in order to improve the user experience and the platform.

WonaSports reserves the right to update these Terms to reflect legal, technical or commercial changes. Relevant modifications will be notified through the application. Continued use of the service after publication implies acceptance of the new Terms.

WonaSports may discontinue or suspend the platform temporarily or permanently for reasons of maintenance, updates, commercial decisions or legal requirements, endeavoring to give advance notice where feasible.

Breach of these Terms, the use of false data or manipulation of the system may result in the definitive cancellation of the user's account, without releasing them from financial obligations previously incurred.

Sports Centers are independent entities. WonaSports is not a partner, does not manage their facilities, does not control their staff and does not determine their prices. It solely provides the software as a management and intermediation tool.

Each Sports Center is directly answerable for the quality of the service, its employees, the condition of its courts and legal compliance. Any claim regarding the sports activity must be directed to the responsible establishment.

The relationship between WonaSports and the Sports Centers that use the management software (SaaS) is governed, in addition to these Terms, by the specific contracts and commercial agreements signed between both parties.

The user undertakes to make legitimate use of the platform, respecting applicable law, intellectual property, these Terms and the internal regulations of each Sports Center.

The user may not transfer their account or their rights under these Terms. WonaSports may assign its rights or obligations to affiliated companies or acquirers without requiring prior authorization.

If any clause of these Terms is declared null or unenforceable by a competent court, the remaining provisions will remain in full force and effect.

WonaSports' failure to enforce any clause will not constitute a waiver of its rights to enforce it in the future.

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which the company operating WonaSports is legally incorporated.

To resolve any dispute arising from the use of WonaSports, the parties submit to the ordinary courts of the registered domicile of the company operating WonaSports, unless a mandatory legal provision states otherwise.
